GRAND AIR CHARTERS PASSENGER INDEMNITY AND EXCLUSION OF LIABILITY

I/we, the undersigned, accept full responsibility for any loss I/we might suffer as a result of injury, illness, loss of life, or damage or loss of property that I/we may sustain during the proposed flight from any cause in the air or on the ground whatsoever or howsoever arising and I/we indemnify and hold the pilot in command, its agents, employees, and associates, harmless against any such claim whether or not such injury, loss or damage can be attributed directly or indirectly to the negligence of whatsoever nature or degree on the part of the pilot in command, Grand Air Charters, its agents, employees, and associates.

I/we record that I/we are aware of the inherent risks involved in flying, which risks include loss of damage to personal property, injury or fatality, accident or illness, and weather. Knowing the inherent risks and dangers involved I/we certify that I/we are fully capable of participating in flying and that I/we will obey the lawful instructions of the pilot in command covering any aspects of the flight and I/we acknowledge that I/we are fully bound and will comply with those instructions.

I/we voluntarily assume the risk inherent in taking part in the flight. My/our general health is good and there is nothing to my/our knowledge that renders me/us unfit to participate in the flight. This exclusion of liability and indemnity is binding on my/our heirs, dependents, executors, and assigns.

Notwithstanding anything to the contrary contained in this Indemnity, “claim” means any liability in excess of the sum/s insured by the pilot in command, the aircraft owner, Grand Air Charters, its agents, employees and associates in respect of all sums which the latter entities shall become legally liable to pay and shall pay as compensatory damages in respect of accidental bodily injury and/or accidental damage to property caused by the aircraft or by any person in terms of any insurance policy currently in force. It is recorded that such limitations on insurance applies in aggregate in any one accident or occurrence and not in respect of each passenger. I/we waive and abandon any claims over and above funds available from such insurance currently in force arising from an accident or occurrence.

  1. Smoking – Smoking is strictly forbidden on all flights.
  1. Quotation Price – This quotation is valid for 7 days from the date of quotation. Any fuel price increase above USD1.00 per liter (JET A1 Fuel) will be added as a fuel surcharge as these fluctuations are direct costs beyond the control of Grand Air Charters.
  1. Aircraft Availability – From acceptance of the quotation, Grand Air Charters will provisionally reserve the aircraft type. Should there be any unforeseen reason, we reserve the right to appoint another aircraft type. The quotation is subject to aircraft serviceability.
  1. Overflight / Landing Permits – A flight shall not commence without the relevant permits, permissions, and indemnities (48 hours in advance) being issued where necessary i.e., authorizations for international flights or permits for landings at privately owned airfields.
  1. Payment – Full payment for the flight must be made 48 hours prior to departure by bank-guaranteed cheque, direct transfer, cash, or Visa debit or credit card.
  1. Weather Diversions and Delays – Delays, cancellations, and diversions due to weather are unfortunately beyond our control and will therefore be at the client’s expense.
  1. Dangerous Goods – Dangerous goods (and relevant paperwork) must be declared and packed accordingly per the IATA dangerous goods regulations. Grand Air reserves the right to inspect and deny boarding of nondeclared baggage.
  1. Availability of Fuel – The quotation is subject to the correct fuel being available at the destination or enroute.
  1. Operating Hours – Quotations are based on daylight hours only. Should after-hour operations be required (and facilities are available) any cost incurred will be for the client’s account.
  1. Luggage – Personal baggage shall be limited to a maximum of 15 kg soft bags plus a 5kg hand luggage allowance per person. (subject to passenger loads). Excess baggage will only be permitted if approved and arranged with Flight Operations. There will unfortunately be no exceptions where full loads exceed the minimum safe operating levels. Bags will be offloaded if compliance is not achieved.
  1. Cancellation Fees

        20% of the quotation amount 7 days in advance

        30% of the quotation amount 48 hours in advance

        50% of the quotation amount 24 hours in advance

        100% of the quotation amount on the same day

Please note: No passengers can be added to the confirmed number for the flight without Grand Air Operations being notified at least 24 hours prior to take off and subsequent approval being granted.
